Policies and Agreements

  • Guest Capacity: Maximum 6 guests (Coast Guard regulations); no children under 12, no wheelchairs, no animals, and no rowdy parties.

Key Policies

  • Property Damage (Artificial Tans): Strict policy prohibiting artificial/aerosol spray tans and high-pigment lotions from staining white upholstery; guests will be charged cleaning or replacement fees for transferred stains.
  • Footwear: No high heels or black-soled shoes allowed. A shoe basket will be provided upon boarding for guests to store their street shoes.
  • Food and Beverage: BYOB is permitted with a limit of 1 cooler. The boat will provide cups, plates, and utensils if needed. Food and drink are permitted but restricted to specific designated areas of the boat to protect the decks and cabin.

Guest Code of Conduct: Six Passenger Captained Charter

  • Follow all instructions from the captain and crew at all times.
  • Wear life jackets when directed.
  • Keep hands, feet, and belongings inside the vessel while underway.
  • Remain seated during docking, anchoring, or rough conditions.
  • Report any hazards, injuries, or equipment issues immediately.
Safety First
Respect for the Captain’s Authority
  • The captain’s decisions regarding safety, navigation, and itinerary are final.
  • The captain may modify or cancel activities due to weather, safety concerns, or guest behavior.
  • Failure to follow instructions may result in early termination of the charter without refund.
Responsible Behavior
  • Consume alcohol in moderation.
  • Illegal substances are strictly forbidden.
  • Avoid reckless actions such as running, climbing on railings, or jumping while the vessel is moving.
  • Treat all guests, crew, and surrounding boaters with courtesy.
Care for the Vessel
  • Use all equipment as instructed.
  • Keep food, drinks, and personal items secured.
  • Avoid actions that may cause stains, scratches, or damage.
  • Do not tamper with navigation systems, engine controls, or safety gear.
Cleanliness
  • Dispose of trash in designated containers.
  • Keep shared areas tidy.
  • Notify the crew of spills so they can be cleaned promptly.
Environmental Stewardship
  • Never throw anything overboard.
  • Respect marine life and protected areas.
  • Follow all local environmental regulations.
Timeliness
  • Arrive on time for departure
  • Return promptly after any stops or water activities.
  • Understand that late arrivals may shorten the charter duration.
Personal Belongings
  • Secure valuables and electronics.
  • Use waterproof protection when appropriate.
  • The charter is not responsible for lost or damaged personal items.
  • Guests are responsible for damage caused by themselves or their party.
  • Any damage must be reported immediately.
  • Repair or replacement costs will be charged to the charterer.
  • A security deposit of $500.00 will be required prior to departure.
  • The deposit will be used to cover repair costs, replacement of damaged items, or cleaning fees beyond normal use.
  • If repair costs exceed the deposit, the charterer is responsible for the remaining balance.
  • The charterer will allow the charter company to charge the card on file for damages that exceed the security deposit.
  • Failure to pay may result in additional fees or legal action.
  • Deposits are refunded after inspection if no damage is found.
Financial Responsibility
Acknowledgment
By boarding the vessel, all guests acknowledge and agree to the terms of this Property Damage Policy. The charterer is responsible for ensuring all passengers understand these rules.

Liability Waiver and Release of Claims

  • Slips, trips, and falls.
  • Sudden vessel movements.
  • Weather‑related hazards.
  • Injuries from water activities.
  • Equipment malfunction.
  • Risks associated with alcohol consumption.

Six‑Passenger Captained Boat Charter

This Liability Waiver (“Agreement”) is entered into by the undersigned guest (“Participant”) as a condition of boarding and participating in activities aboard the charter vessel (“Vessel”). By signing below, the Participant acknowledges and agrees to the following terms.
Assumption of Risk
The Participant understands and accepts that boating and related activities involve inherent risks, including but not limited to:
The Participant voluntarily assumes all risks, whether foreseeable or not, associated with participation in the charter.
Release of Liability
To the fullest extent permitted by law, the Participant releases and holds harmless:
  • The vessel owner,
  • The captain and crew,
  • The charter company, its employees, agents, and contractors,
from any and all claims, demands, causes of action, damages, losses, or liabilities arising out of or related to participation in the charter, including those resulting from ordinary negligence. This release does not apply to gross negligence or intentional misconduct.
Medical Fitness
The Participant certifies that they:
  • Are physically able to participate in boating and water activities.
  • Have disclosed any medical conditions that may affect safety.
  • Are not under the influence of drugs or alcohol beyond safe limits.
The Participant is responsible for bringing any necessary medications and informing the captain of relevant medical concerns.
Personal Property
  • Lost, stolen, or damaged personal items.
  • Water damage to phones, cameras, or electronics.
  • Items dropped overboard.
Participants are encouraged to secure valuables appropriately.
The Participant understands that the charter company is not responsible for:
Compliance with Rules
The Participant agrees to:
  • Follow all instructions from the captain and crew.
  • Comply with the Guest Code of Conduct.
  • Use equipment only as directed.
  • Refrain from unsafe or disruptive behavior.
Failure to comply may result in early termination of the charter without refund.
Alcohol and Substance Use
The Participant acknowledges that:
  • Alcohol consumption is at one's own risk.
  • Excessive intoxication may result in restricted activities or early return.
  • Illegal substances are strictly prohibited.
Photo and Video Release (Optional)
The Participant grants permission for the charter company to use photos or videos taken during the charter for promotional purposes, unless they opt out in writing.
Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the Commonwealth of Massachusetts.
